A lei tutelar educativa e a delinquência juvenil feminina: Caraterização e identificação das limitações na aplicação das medidas de internamento

Portugal é, segundo as estatísticas apresentadas em 2017 pela União Europeia, o quarto país com a maior taxa de criminalidade. A entrada dos jovens na criminalidade cada vez mais cedo, alerta a sociedade, e o Estado para o aumento deste problema social. É na resolução deste problema social que a Lei Tutelar Educativa é aprovada em 1999. Esta política pública é apresentada como medida de educação dos jovens para o Direito, promovendo a redução da criminalidade praticada por jovens entre os 12 e os 16 anos. Nesta dissertação centramo-nos no fenómeno da delinquência juvenil feminina e na medida sancionatória associada, a saber, o internamento em centro educativo. Discutimos quais as abordagens teóricas que têm sido realizadas sobre o fenómeno e como tem sindo interpretada a criminalidade feminina. Analisamos os números da delinquência juvenil em Portugal, entre 2015 a 2019, os perfis que compõem esses númenos, e os discursos das jovens institucionalizadas e dos técnicos que as acompanham, de modo a traçar possíveis reformas da lei.

According to the statistics presented in 2017 by the European Union, Portugal is the fourth country with the highest crime rate. The entry of young people into crime at an earlier age, alerts society and the State to the increase of this social problem. It is in the resolution of this social problem that the Lei Tutelar Educativa was approved in 1999. This public policy is presented as a measure of education of young people for the Law, promoting the reduction of crime committed by young people between 12 and 16 years old. In this dissertation we focus on the phenomenon of female juvenile delinquency and the associated sanctioning measure, namely, internment in juvenile detention center. We discuss which theoretical approaches have been taken on the phenomenon and how female criminality has been interpreted. We analyze the numbers of juvenile delinquency in Portugal, between 2015 and 2019, the profiles that compose these figures, and the discourses of institutionalized young people and the technicians who accompany them, in order to outline possible reforms of the law.
