O fenómeno desportivo tem evoluído a um ritmo que o Direito do Trabalho internacional não conseguiu ainda acompanhar na totalidade. E neste aspeto, o ordenamento jurídico português não é exceção. O que nos propomos fazer é um estudo transversal, mas que se debruçará essencialmente sobre uma matéria nova e ainda parcamente estudada neste âmbito, explorando as principais especificidades do contrato de trabalho desportivo no ordenamento português e sua comparação com ordenamentos estrangeiros. Desta feita, o que pretendemos explicar é a forma de compatibilizar a proibição expressa das limitações à liberdade de trabalho do praticante desportivo presente na lei do contrato de trabalho desportivo, com a estipulação (cada vez mais recorrente) das chamadas cláusulas de não concorrência. Defendemos, neste estudo, a legalidade da sua estipulação sem nunca descurar a previsão legal vigente.

The sporting phenomenon has evolved at a rate that the International Labor Law has not yet been able to fully follow. And in this context, the Portuguese legal system knows no exception. Our proposition is to do a cross-sectional study that will focus essentially on a new and still sparsely studied subject in this area, exploring the main specificities of the sport work contract in the Portuguese system and its comparison with foreign systems. What we intend to explain in this dissertation is how to reconcile the express prohibition of the limitations on the freedom of work of the sports practicer present in the law of the sports contract, with the (increasingly recurring) stipulation of the so-called non-competition clauses. We defend, in this study, the legality of its stipulation without ever neglecting the current legal prediction.
