A presente dissertação foca-se numa análise do bloqueio de tomada de decisão no Conselho de Segurança das Nações Unidas (CSNU) e do seu impacto no trabalho humanitário da Agência das Nações Unidas de Assistência aos Refugiados da Palestina no Próximo Oriente (UNRWA), destacando as suas implicações mais amplas para a proteção de civis no conflito de Gaza, especialmente durante o período de três meses (outubro – dezembro), antes do final do ano de 2023. Dentro do quadro do Direito Internacional (DI), a pesquisa procura aprofundar as complexidades apresentadas pelo conflito, analisando o cruzamento entre as obrigações sob o Direito Internacional Humanitário (DIH) para a proteção de civis e as consequências da falta de uma ação decisiva do CSNU, que acabam por dificultar a capacidade de assistência da UNRWA. Através de uma abordagem multidimensional, a presente dissertação incidirá sobre: (a) um estudo de caso para ilustrar as consequências específicas do bloqueio de decisão do CSNU em Gaza; (b) uma análise humanitária através dos relatórios situacionais da UNRWA, de forma a serem identificados os principais desafios da Agência; e (c) considerações jurídicas, como forma de identificar possíveis violações de DIH decorrentes da inação do CSNU. Destaca-se a delimitação temporal do conflito para análise - primeiros 3 meses - dada a impossibilidade de analisar continuamente o conflito, além de este corresponder ao período de estágio curricular onde tive a oportunidade de acompanhar o desenvolvimento do conflito, em primeira mão, na Missão Permanente de Portugal junto das Nações Unidas em Nova Iorque.

This dissertation focuses on an analysis of the decision-making deadlock in the United Nations Security Council (UNSC) and its impact on the humanitarian work of the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA), highlighting its wider implications for the protection of civilians in the Gaza conflict, especially during the three-month period (October - December) before the end of 2023. Within the framework of International Law (IL), the research seeks to delve into the complexities presented by the conflict, analyzing the intersection between obligations under International Humanitarian Law (IHL) for the protection of civilians and the consequences of the lack of decisive UNSC action, which ultimately hamper UNRWA's ability to assist. Through a multidimensional approach, this dissertation will focus on: (a) a case study to illustrate the specific consequences of the UNSC's decision blockage in Gaza; (b) a humanitarian analysis through UNRWA's situational reports, to identify the Agency's main challenges; and (c) legal considerations, as a way of identifying possible violations of IHL resulting from the UNSC's inaction. It is worth highlighting the time frame of the conflict to be analyzed - the first three months - given the impossibility of analyzing the conflict continuously, as well as the fact that this corresponds to the period of my curricular internship where I had the opportunity to follow the development of the conflict, firsthand, at the Permanent Mission of Portugal to the United Nations in New York.
