A presente dissertação tem como objetivo principal analisar as alterações implementadas pela Agenda do Trabalho Digno, materializada na Lei n.º 13/2023, de 3 de abril, ao Regime Jurídico do Contrato de Serviço Doméstico, que se encontra regulado pelo Decreto-Lei n.º 235/92, de 24 de outubro. O contrato de trabalho doméstico, categorizado como um contrato especial, manteve-se petrificado durante 30 anos, ao passo que o regime laboral comum tem vindo a sofrer alterações. Neste sentido, tratava-se, até à alteração, de um regime esquecido e desfasado, que pelas suas particularidades e aproximação entre as partes, apresentava algumas fontes de vulnerabilidades e riscos. Assim, procurámos não só efetuar uma leitura crítica às alterações implementadas pela Agenda ao regime, como também analisar as possíveis lacunas que ficaram por responder. Reconhecemos ainda a importância de analisar as especificidades deste regime especial inserido no universo familiar, caracterizado por constituir um vínculo jurídico com uma acrescida intimidade e confiança, a qual não é observada no setor empresarial.

The dissertation herein aims to provide an in-depth review of the changes implemented by the Agenda for Decent Work, embodied in Law n.º 13/2023, from April 3rd, to the Legal Regime of Domestic Service Contracts, which is regulated by Decree-Law n.º 235/92, of October 24th. The domestic employment contract, categorized as a special contract, has remained unchanged for 30 years, while the common labor regime has undergone modifications throughout the period. Consequently, until the recent changes, this has been an overlooked and outdated regime which, due to its unique characteristics (including the particularly close bond between parties) presented a number of risks and limitations. As a result of the above, the present review aims at not only providing a critical analysis of the changes introduced by the Agenda to the regime (including the identification of matters which might be further explored), but also acknowledging the importance of examining the specificities of this special regime within the family context which establishes a legal bond characterized by an increasing level of trust and intimacy which is typically not observed in the business sector.
