O presente trabalho constitui um exercício de reflexão crítica sobre o instituto do whistleblowing no
contexto laboral, tendo como ponto de partida a análise da relevância da jurisprudência do Tribunal
Europeu dos Direitos Humanos e dos instrumentos do Conselho da Europa na génese da Diretiva (UE)
2019/1937.
Partindo deste enquadramento, procede-se a uma leitura comparativa do panorama europeu com o
ordenamento jurídico português, em particular através da análise da referida Diretiva e da Lei n.º
93/2021, de 20 de dezembro, que transpõe aquele diploma para a ordem interna.
A experiência prática demonstra que a aplicação do regime jurídico do whistleblowing se confronta
frequentemente com situações ambíguas e zonas de incerteza, o que coloca desafios relevantes à
uniformidade da interpretação e aplicação do direito.
É nesse espaço de indefinição que este trabalho procura contribuir, através da análise crítica de
contributos doutrinais e jurisprudenciais, para a clarificação dos contornos normativos e das tensões
inerentes à proteção dos denunciantes.
Particular destaque é dado à articulação do whistleblowing com problemáticas próprias do direito do
trabalho, nomeadamente com o regime disciplinar laboral, terreno onde emergem de forma mais
evidente as dificuldades práticas e teóricas da sua aplicação.
O estudo assinala caminhos possíveis para uma resposta sistemática a estas questões, sem pretender
esgotar a reflexão, mas antes incentivar o debate académico e legislativo, bem como a evolução
interpretativa necessária para uma efetiva consolidação deste instituto no ordenamento jurídico
português.

The present work constitutes an exercise in critical reflection on the institution of whistleblowing in
the employment context, taking as its starting point the analysis of the relevance of the case law of
the European Court of Human Rights and of the instruments of the Council of Europe in the genesis of
Directive (EU) 2019/1937.
From this framework, a comparative reading is carried out between the European landscape and the
Portuguese legal system, in particular through the analysis of the aforementioned Directive and Law
No. 93/2021 of 20 December, which transposes that instrument into the domestic order.
Practical experience shows that the application of the legal framework on whistleblowing often
encounters ambiguous situations and areas of uncertainty, which pose significant challenges to the
uniform interpretation and application of the law.
It is within this space of indeterminacy that this study seeks to make a contribution, through a critical
analysis of doctrinal and case law perspectives, towards clarifying the normative contours and the
inherent tensions in the protection of whistleblowers.
Particular emphasis is placed on the interaction between whistleblowing and issues specific to labour
law, namely the disciplinary regime at work, a field where the practical and theoretical difficulties of
its application most evidently emerge.
The study highlights possible paths towards a systematic response to these issues, without claiming to
exhaust reflection, but rather to encourage academic and legislative debate, as well as the
interpretative developments necessary for the effective consolidation of this institution within the
Portuguese legal system.
